While the Biden administration has deemed DACA recipients "lawfully present" for the purposes of ACA enrollment, a lawsuit filed in North Dakota seeks to overturn this rule, arguing that it will cause administrative and resource burdens for states. The lawsuit, filed in August, aims to postpone the rule's effective date and prevent DACA recipients from accessing ACA coverage.
